The Nigerian Communications (Type Approval) Regulations, issued under Sections 70 and 134 of the Nigerian Communications Act 2003, introduce a detailed approval framework to ensure that all communications equipment in Nigeria is safe, reliable, and meets specified technical standards. The Regulation requires every Equipment Holder (manufacturer, supplier, or operator) to secure or rely on a valid Commission approval unless expressly exempted.

The application process involves submitting technical documentation and test reports, which the Commission can verify through recognised test labs or additional testing. Approved devices must display labels and conform to ongoing obligations (e.g., record-keeping, compliance with electromagnetic limits, or recall if found unsafe or interfering). Provisional approvals may be granted for up to 180 days for prototypes or research devices, after which final certification or withdrawal is required. The Regulation also addresses revocations of approvals (e.g., in cases of fraud or updated technical standards), sets out a schedule of fees, empowers the Commission to investigate potential violations, and stipulates penalties such as fines or operational restrictions where non-compliance persists.
